The book offers the first thorough legal analysis of the practice of mixity since the Lisbon Treaty, providing the perspectives of international, EU, and national law.

It sets out a detailed theoretical understanding of mixity, the common commercial policy, and the recent case law of the EU Court of Justice. It assesses recent practice and current challenges, such as the non-ratification of mixed agreements, ensuring parliamentary participation in EU treaty-making, the new architecture for concluding EU trade and investment agreements, as well as the new trade agreement between the EU and the UK post-Brexit.

In so doing, the author argues that in the field of trade and investment, mixity is no longer a procedural technique to overcome legal uncertainties about competence allocations between the EU and the Member States. Instead, mixity has become a deliberate substantive design choice. This brings a fresh and innovative perspective to a key tenet of EU external relations law.

About the author

Dr. Gesa Kübek is Assistant Professor in European Law at the University of Groningen, Netherlands. Dr. Kübek was previously a Research Associate at Leuphana University Lüneburg, Germany (2019-2021) and at the University of Passau, Germany (2016-2019). She was a visiting PhD student at the European University Institute (EUI), Florence, Italy (2017).

Dr. Kübek undertook internships at the T.M.C. Asser Instituut (2015-2016) and the German Federal Foreign Office (2013). Dr. Kübek holds a doctorate in law from the University of Passau that was marked summa cum laude (1,0).

She obtained an LL.M. in Law and Economics from the Universities of Bologna, Italy, Ghent, Belgium, and Hamburg, Germany (with distinction) and an Honour’s Bachelor degree in European Public Administration from the University of Twente, Enschede, Netherlands.

Dr. Kübek’s research focuses on the law and practice of EU external relations. She has a specific interest in the EU's external trade and investment relations and mixed agreements.
